A big “thank you” in advance to those people who I have talked to over the past couple of days, who have now confirmed their commitment to providing affidavits in support of my Notice of Defence, and who will also be attending the Auckland District Court in person on the day of the above Hearing.

For many of you, this will be the first time that you have ever had an opportunity to submit your evidence of Grant King defrauding you, to a District Court Hearing.

You will not be alone in your endeavour.

Affidavits will need to be into me by Friday 28th February 2014, and may be posted to:

Please ensure that you:

a/ Have the affidavit signed off by a Solicitor, or Justice of the Peace (most legal firms provide document signing as a free service to the public -just walk into your local legal firm and request document signing assistance, or visit the local Citizens Advice office for JP assistance).

b/ Attach any evidence to your affidavit, and have this signed off as well.

For those who will be attending the Hearing in person, I will meet you outside the nominated Hearing room on the day – the Hearing Room venue will be posted on the Court Hearings Schedule in the Auckland District Court building.

Media interest in this Hearing has also been confirmed over the past couple of days, and I am updating interested media parties as this event progresses.

 

Trade Me re-list Trident Cycles under false account name, despite Consumer advisory warning, and ADMIT that undischarged bankrupts are allowed to trade on the Trade Me site.

Trade Me have re-listed Grant Kings account “Cycles2u”, and the Trident Bike products, despite being warned about Grant King, and despite Trident Cycles and Grant King being banned from a major cycling industry event this week.

It appears that Trade Me are going to choose ignorance over wisdom regarding this issue – and Trade Me consumers are going to be the victims.

When the future consumer victims find out that Trade Me knew about the Grant King & Trident Cycles listing fraud, and listed their product anyway…………

I have had a response from Trade Me today:

Hi Steve,

Thanks for getting in touch again with your concerns.

Please be aware we’ve entered into lengthy discussions with the directors of Tern Marine and Trident Cycles, and their legal representation. They’re aware of Mr. King’s history on our site, and of the allegations made on your blog.

We take the complaints of this nature very seriously. As you are aware, we do not allow undischarged bankrupts to trade on the site in most circumstances.

To demonstrate the seriousness we take these matters, we suspended the cycles2u account while we investigated the matter. We have investigated the matter and have taken steps to ensure that Mr King is not operating the cycles2u account. I’m not able to discuss this in further depth with you due to our Privacy Act obligations, as outlined in our earlier correspondence.

Please also be aware that a number of the statements and allegations you make about Trident Cycles are inaccurate. Trident Cycles may have grounds for a defamation complaint in this instance. Should the company consider taking further legal action, Trade Me could be obligated under the Privacy Act to supply your correspondence with us to assist in any proceedings against you, as it constitutes their personal information.

Hi,

At the risk of me sounding blunt, if “taking steps to ensure Mr King is not operating the Cycles2u account” is the best you have come up with, then Trade Me have been well and truly “played”.

Grant King IS Cycles2u – Grant King IS the NZ Manager for the company – unless you are sitting right next to him, there is nothing you can actually do to stop him operating the account.

You don’t allow undischarged bankrupts to operate on the Trade Me site in MOST cases?

Excuse me? So there ARE undischarged bankrupts operating accounts on Trade Me?

Is the general public aware of this?

I would be grateful if you could explain to me how you have come to believe that the statements I have made about Trident Cycles are inaccurate.

You seemed to have left our victims group right out of the investigation – did it occur to you that we might hold some evidence to back up our claims?

Yes, let Trident, Tern, or whatever they are calling themselves take defamation action against me – Truth and honest opinion are absolute defences to the tort of defamation, and we have both defences well covered.

When the bike frauds and worthless, unenforceable warranties start to pile up in the not-too-distant future, I will be sure to come back to you and see how those “steps” Trade Me took to protect New Zealand Consumers (and Trade Me account holders) worked out.

 Trident Cycles have given an undertaking to Trade Me that Grant King won’t be operating the “Cycles2U” Trade Me account.

Let’s all see how THAT all works out.

Congratulations to the very helpful person from the cycling industry who tipped us off about Grant King’s intention to head down to the MTB Bike Festival & Trade Show being held this week.

I have spoken with the Festival organisers today, and they are well aware of who Grant King is, and under no circumstances will Grant King be “setting up shop” at the Festival – they are onto him, and he isn’t remotely welcome.

Once again as a result of the Consumer Advocacy Network that has grown within this website, the possibility of Grant King creating more fraud victims has been minimised.

Well done to you, the readers, for spreading the word so effectively.

While Grant King is understandably furious at being caught out breaching Trade Me’s Terms and Conditions of trade, and having over $52,000.00 in stock de-listed from Trade Me, this hasn’t stopped him “hitching his wagon” and trundling around the country to various Bike festivals:

A reader in the cycling industry has alerted me to this little “Tour-De-Fraud” that Grant King is perpetuating on various festivals, and it seems that Grant Kings practice of not paying his bills has now extended to Grant King not paying his show stand fees as well at various events, shows, and festivals.

Bike Festival organisers would thus do well to read this website, and the “Timeline” and the “Media Articles” library- because they may well become the next fraud victim listings on the “Timeline” in 2014.

In response to enquiries from a number of Grant King’s apparently (according to King) non-existent fraud victims:

Fraud victims of Grant King have the opportunity of giving testimony against Grant King at my Notice of Defence on 12/3/14 at the Auckland District Court.

According to legal advice, all I need to do is file a “General Memorandum” of fraud victims of Grant King that wish to give testimony against Grant King at my Notice of Defence, and submit this “General Memorandum” with my Notice of Defence & Evidential Affidavit (which would include all of the affidavits in support from other fraud victims of King), and request that these fraud victims be heard as witnesses within closed Court.

Prior to the Hearing, the Judge reads the Notice of Defence, the Evidential Affidavits, the General Memorandum, and then determines as to whether he / she will permit testimony to be given at the Hearing.

This means two things:

a/ Grant King will have to defend the multiple statements of perjury he has now filed in his application to the Court, against witnesses who will have filed evidential affidavits against King, that will refute Kings claims of no fraudulent activity against these same victims occurring;

b/ If King objects to witnesses being called against him, the Judge will most likely ask him / herself why King suddenly has a host of “non-existent” fraud victims wishing to testify against King, and just what King believes he has to fear from these same “non-existent” witnesses and victims of Grant Kings fraud.

Long story short – in filing the Application against me and this website – King has just snookered himself.
